End User License Agreement

1. License Grant

Subject to your continued compliance with this EULA, the Terms of Service, and Discord's policies, CertiFried ("we", "us", the "Licensor") grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Invite and operate the CertiFried MultiTool bot in Discord servers you own or administer;
• Access and use the web dashboard at certifriedmultitool.com to configure those servers;
• Use the bot's commands and features for their intended personal and community purposes.

This is a license to use the software as a service — it is not a sale. No ownership of the software is transferred to you.

2. Scope of Permitted Use

The license above covers all standard bot and dashboard functionality, including moderation and security tools, multi-platform streaming and social feed notifications, music and voice features, leveling, economy, the Dungeons & Dragons 5e RPG (/rpg), word games, Cards Against Humanity and other games, ticket and form systems, Stream Team signups, greeting cards, and creator integrations (Buy Me a Coffee, Throne, Fourthwall, Steam).

Where you connect third-party accounts (e.g. Twitch, YouTube, Kick, Google Gemini, Meta, Buy Me a Coffee), you grant us permission to access those services on your behalf solely to deliver the feature you enabled, and you remain responsible for complying with each third party's terms.

3. License Restrictions

You may not, and may not permit anyone else to:

• Copy, reproduce, distribute, resell, rent, lease, or commercially exploit the software except as expressly permitted here;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, except to the limited extent applicable law prohibits this restriction;
• Modify, adapt, translate, or create derivative works of the bot or dashboard;
• Remove, obscure, or alter any copyright, trademark, or other proprietary notices;
• Use the software to build or train a competing product or service;
• Circumvent, disable, or interfere with security, rate-limiting, authentication, or licensing mechanisms;
• Access the software through automated means (scraping, bots, scripts) other than the supported Discord and dashboard interfaces;
• Use the software for any unlawful purpose or in any way that violates the Terms of Service.

4. Ownership and Intellectual Property

The CertiFried MultiTool bot, dashboard, source code, designs, logos, command structures, documentation, and all related intellectual property are and remain the exclusive property of CertiFried and its developers. All rights not expressly granted to you in this EULA are reserved.

"CertiFried", the CertiFried logo, and related branding are trademarks of the Licensor. This EULA does not grant you any right to use them except to identify the service.

5. Your Content

You retain ownership of the content you and your community submit through the software — including messages, greeting-card signatures, images, voice recordings, configuration data, and game progress. By submitting content, you grant us a limited, worldwide, royalty-free license to host, store, process, transmit, and display that content solely for the purpose of operating and providing the service to you.

You are responsible for ensuring you have the rights to any content you submit, and that it complies with the Prohibited Activities section of our Terms of Service. We do not claim ownership of your content and do not sell it. See our Privacy Policy for how data is handled.

6. Custom Bot Instances

CertiFried offers self-service and managed "custom bot" instances that run the CertiFried software under your own Discord application and token. The license, restrictions, and ownership terms in this EULA apply equally to custom bot instances. You are responsible for safeguarding any bot tokens or credentials you provide; we store provided tokens in encrypted form and use them only to operate your custom bot.

7. Updates and Changes

The software is provided as an evolving service. We may add, modify, suspend, or remove features, commands, or integrations at any time, and may update or restart the bot to deliver improvements and fixes. We may revise this EULA from time to time; changes are effective upon posting, and your continued use of the software constitutes acceptance of the revised EULA.

8. Fees and Donations

The CertiFried MultiTool license is currently provided free of charge. Voluntary donations support development and hosting costs; they are non-refundable and do not purchase, expand, or guarantee any license rights, features, or service levels beyond those generally available to all users.

9. Term and Termination

This EULA is effective until terminated. Your license terminates automatically and immediately if you breach any of its terms. You may terminate the license at any time by removing the bot from your servers and ceasing use of the dashboard.

We may suspend or terminate your license, with or without notice, for any violation of this EULA or the Terms of Service. Upon termination, you must stop all use of the software. Sections covering ownership, restrictions, disclaimers, and limitation of liability survive termination.

10. Disclaimer of Warranties

The software is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the software will be uninterrupted, error-free, secure, or that it will meet your requirements. You use the software at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, CertiFried and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of (or inability to use) the software. Our total aggregate liability shall not exceed $100 USD or the amount you paid us in the twelve months preceding the claim, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless CertiFried and its developers from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use or misuse of the software, your violation of this EULA, or your infringement of any third-party right.

13. Relationship to Other Agreements; Governing Law

This EULA supplements and is incorporated into our Terms of Service and Privacy Policy. If there is a direct conflict between this EULA and the Terms of Service regarding the license to use the software, this EULA controls for licensing matters. This EULA is governed by applicable law without regard to conflict-of-law principles, and any disputes will be handled as described in the Terms of Service.
